This website is operated by The Mad Hatter Co. Throughout the site, the terms “we,” “us,” and “our” refer to The Mad Hatter Co. This platform is intended exclusively for approved wholesale customers purchasing on behalf of a business. By accessing or using the site, you confirm that you are acting in a commercial capacity and agree to be bound by the following terms and conditions.

If you do not agree to these Terms of Service, you may not access the website or use any of our services.

1 – Wholesale Eligibility

By registering or purchasing from our wholesale site, you confirm that:

  • You are at least 18 years old

  • You are authorized to represent and make purchases on behalf of your business

  • You are purchasing goods solely for resale and not personal use

We reserve the right to reject or terminate wholesale accounts that fail to meet our criteria or violate our policies.

2 – Order Processing & Fulfillment

  • Shipping Timeline: Orders ship within 14 business days unless otherwise noted

  • Carriers: Orders are shipped via UPS or USPS

  • Free Shipping: Applied to wholesale orders over $750 USD

  • Expedited Shipping: Available upon request; customer is responsible for all expedited shipping fees

  • Split Shipments: May occur depending on stock availability

Please ensure all shipping information is accurate. We are not responsible for delays or lost packages due to incorrect addresses.

3 – Returns & Exchanges

Returns are accepted under the following conditions:

  • Return requests must be submitted within 30 days of delivery

  • All approved returns are subject to a 20% restocking fee

  • Shipping costs (original and return) are non-refundable

  • Items must be unworn, unwashed, and in resellable condition

  • Custom, branded, or made-to-order products are final sale

Exchanges may be approved if inventory allows.
To initiate a return or exchange, email crabitaille@themadhatterco.net with your order number, reason, and photos (if applicable). We will provide a return label.

We reserve the right to waive or enforce restocking fees at our discretion.

4 – Damaged or Incorrect Items

If your order arrives damaged or incorrect:

We will review your claim and offer a replacement, refund, or credit, depending on the situation.

5 – Order Cancellations

Order cancellations must be requested within 7 days of purchase.
Approval of cancellations is at our discretion and may depend on order status.
Custom or made-to-order items cannot be canceled once production begins.

6 – Payment Terms

  • Standard orders require payment at checkout

  • Approved accounts may be eligible for Net 30 terms, with a 10% deposit required at the time of ordering

  • Late payments may result in account suspension or shipping delays

7 – Resale Policy

You may not resell our products on TikTok Shop, Amazon, or any mass consumer marketplace without prior written approval.

Violation of this policy may result in immediate account termination.

8 – Account Monitoring & Policy Enforcement

We reserve the right to:

  • Deny returns from customers with excessive return activity

  • Cancel or suspend wholesale accounts for policy violations

  • Blacklist accounts that misuse access or violate our resale rules

9 – Intellectual Property

All designs, logos, and product content are the exclusive property of The Mad Hatter Co.
No use or reproduction is permitted without written consent.

10 – Limitation of Liability

The Mad Hatter Co. shall not be held liable for any indirect, incidental, or consequential damages resulting from the use of our site or products. All products are sold as-is for commercial resale use only.

11 – Indemnification

You agree to indemnify, defend, and hold harmless The Mad Hatter Co., its owners, and employees from any claim or demand arising out of your breach of these Terms or misuse of the site or products.

12 – Governing Law

These Terms are governed by the laws of the State of Georgia. Any legal disputes shall be handled in the courts of Tift County, GA.

13 – Changes to Terms

We may update these Terms of Service at any time. Continued use of the site after changes constitutes your acceptance of the updated terms.
